Regulatory Authority for Electronic Communications and Postal Services is the national regulatory authority and pricing authority in the sector of electronic communications and postal services. The Office is presided by a Chairman - Mr. Ivan Marták, who is a statutory body and is elected and recalled by the National Council upon a proposal of the Government. The Chairman, in time of his absence, is deputised by the Vice-Chairman of the Office - Mr. Ján Fľak. Besides that, the Vice-Chairman fulfils tasks assigned by the Chairman. The Vice-Chairman is appointed and recalled by the Government.
According to the law:
State administration authorities in the area of electronic communications are as follows:
- Ministry of Transport, Posts and Telecommunications of the Slovak Republic,
- Regulatory Authority for Electronic Communications and Postal Services.
The Regulatory Authority is the national regulatory authority and pricing authority in the area of electronic communications which, pursuant to this Act
- Performs regulation of electronic communications,
- Provides for international relations in the electronic communications sector at the level of regulatory authorities, actively participates in the activities of the Body of European Regulators for Electronic Communications (hereinafter referred to as „Body of European Regulators“), and supports its tasks concerning upholding better coordination and consistency at regulation.
- Cooperates with the Ministry in elaboration of the proposal of the national frequency spectrum table and performs management of the frequency spectrum,
- Protects interests of end users with regard to the quality and prices of services,
- Fulfils obligations supporting effective competition, effective investments and innovation, development of the common market of the European Union, interests of all persons of Member States in the territory of the Slovak Republic, adequate access to networks, interconnection of networks and interoperability of services and protects freedom of carrier selection,
- Issues generally binding legal regulations within the limits of this Act,
- Publishes the Journal of the Regulatory Authority for Electronic Communications an Postal Services (hereinafter referred to as “Journal “),
- Sets administrative payments under Subsection 4,
- Leads out-of-court dispute resolution,
- Provides end users information concerning services, performs users’ researches, publishes them and uses them in its activities,
- Fulfils tasks related to restriction of proprietary rights to real estates in respect of using real estates for the purposes of ensuring the services and tasks related to restriction of proprietary rights to movable assets by restriction or ban on using transmission telecommunications facilities and circuits at the time of war and belligerency ,
- Executes state supervision on electronic communications (hereinafter referred to as „supervision“),
- Imposes sanctions for infringing the obligations stipulated by this Act,
- Recognizes special professional capability to operate selected radio equipment under the special regulation,
- Executes other activities under a special regulation.
The Regulatory Authority imposes administrative charges on
- undertakings providing networks or services based on the general authorisation,
- the right to use numbers based on the individual authorisation for the use of numbers, or
- the right to use frequencies based on the individual authorisation for the use of frequencies.
The Regulatory Authority for Electronic Communications and Postal Services, which is the state administration body with nationwide coverage in the area of electronic communications and postal services, performs in the area of postal services:
- tate regulation of postal services and postal payment service,
- state supervision over the provision of postal services and postal payment service,
- international cooperation in the area of postal services at the level of regulatory authorities,
- function of notification body in the area of state regulation in relation to bodies of the European Union and to relevant bodies of the member states of the European Union and to relevant bodies of the member states of the European Free Trade Association,
- other activities according to Act,
- statistic survey for the area of postal services.
